Terms of Service

These Terms and Conditions (the “Terms”) govern your access to and use of Drishti (the “Service”), the real-time media intelligence dashboard operated by NETRAX INTELLIGENCE (OPC) PRIVATE LIMITED (“Drishti”, “we”, “us”, “our”, or the “Company”). By signing up for, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Definitions
- Service means the Drishti dashboard, mobile views, daily briefings, alerts, APIs, and any associated software or content we make available.
- Workspace means the isolated tenant environment provisioned for your organisation.
- Customer means the legal entity that has signed up for or is paying for a Workspace.
- User means any individual authorised by the Customer to access the Service.
- Customer Data means content, queries, configurations, and outputs stored within your Workspace.
Use of Service
You may use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service in any way that violates applicable Indian law (including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023), or any other applicable national or international law or regulation.
You agree not to:
- Use the Service to monitor, harass, or infringe the rights of any individual where such activity is unlawful in the relevant jurisdiction.
- Attempt to gain unauthorised access to the Service, other Workspaces, or the underlying infrastructure.
- Upload or submit content that is unlawful, defamatory, infringing, or designed to disrupt the Service.
- Resell, sublicense, or commercially exploit the Service or any output without our written permission.
Account Registration and Workspace Configuration
You are responsible for the accuracy of the information you provide at sign-up, the security of your credentials, and all activity that occurs under your Workspace. You must notify us promptly of any suspected unauthorised access.
Intellectual Property
The Service, including all software, design, copy, dashboards, briefings, sentiment models, clustering logic, and underlying methodology, is the exclusive intellectual property of the Company and its licensors. It is protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service strictly for your internal business purposes during the term of your subscription. No other rights are granted by implication, estoppel, or otherwise.
The Drishti name, logo, and all related marks are the trademarks of the Company. You may not use them without our prior written consent.
Reverse Engineering and Anti-Circumvention
You shall not, and shall not permit any third party to, directly or indirectly:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, object code, underlying ideas, algorithms, file formats, or non-public APIs of the Service.
- Modify, translate, or create derivative works based on the Service.
- Circumvent, disable, or interfere with any security, rate-limiting, or access-control feature of the Service.
- Scrape, crawl, mirror, or systematically extract data from the Service other than through a documented and authorised interface.
- Use the Service, its outputs, or any data exported from it to develop, train, or improve a competing product, dashboard, briefing service, or sentiment model.
- Probe, scan, or test the vulnerability of the Service except under a written security research arrangement signed by both parties.
Any breach of this section is a material breach of these Terms and may result in immediate suspension of access without refund, in addition to any other remedies available to us under law.
Customer Data and Ownership
You retain all rights, title, and interest in and to your Customer Data. You grant us a limited, worldwide, royalty-free licence to host, process, transmit, and display your Customer Data solely as required to operate, maintain, and improve the Service for you.
We process Customer Data in accordance with our Privacy Policy. Workspace data is logically isolated, and we do not share it with another customer.
Public Content and Third-Party Sources
The Service ingests publicly available content from news outlets, video platforms, and social media. We do not own this content. The accuracy, copyright, and licence terms of such content remain with the original publisher, and you are responsible for any republication, redistribution, or onward use beyond the in-product viewing for which it is intended.
AI Assistant Connections
Drishti exposes a Model Context Protocol (MCP) endpoint at mcp.getdrishti.inthat allows you to connect third-party AI assistants — ChatGPT, Claude (in any of its surfaces), Gemini, Cursor, and other MCP-compatible clients — to your workspace via OAuth 2.1 with PKCE and Dynamic Client Registration.
Connections are read-only and scope-limited; the assistant cannot write, delete, or trigger outbound communications. You authorise an assistant by signing in to Drishti and approving an explicit consent screen, and you may revoke a connection at any time from Settings → Connected Apps. Tokens are stored as one-way hashes and expire by default after one year.
When you ask a connected AI assistant a question that uses Drishti, the AI provider receives the metadata Drishti returns to fulfil the question (headlines, sentiment labels, outlet names, URLs, aggregate counts — never raw article body text). That data is then processed by the AI provider under its own terms and privacy policy. You are responsible for not connecting assistants whose terms are incompatible with your organisation’s data-handling requirements.
We do not warrant the accuracy of summaries, analyses, or recommendations produced by an AI assistant using Drishti data. Treat AI output as an aid, not a system of record; cross-check material claims against the underlying article links Drishti provides.
Misuse of the MCP endpoint — including attempts to extract data from other customers’ workspaces, abuse rate limits, scrape full article bodies, or bypass the audit log — is a material breach of these Terms and grounds for immediate token revocation and account suspension.
Service Availability and Changes
We aim for high availability but do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may add, modify, or remove features at any time. Material changes that adversely affect a paying Customer’s core functionality will be notified in advance where reasonably practicable.
Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT THE INGESTED CONTENT WILL BE COMPLETE, ACCURATE, OR FIT FOR ANY PARTICULAR PURPOSE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF REVENUE, PROFITS, REPUTATION, OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your use of the Service, your Customer Data, or your violation of these Terms.
Suspension and Termination
We may suspend or terminate your access to the Service if you breach these Terms, if your account is overdue, or if continued provision creates legal or operational risk for us. You may terminate your subscription at any time per the cancellation terms of your plan. Sections that by their nature should survive termination, including intellectual property, reverse engineering, disclaimer of warranties, limitation of liability, indemnification, and governing law, will survive.
Governing Law and Jurisdiction
These Terms and your use of the Service are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Gurugram, Haryana, India.
Modification of Terms
We reserve the right to modify these Terms at any time. The “last updated” date at the top of this page will reflect any change. Material changes will be communicated to Workspace administrators by email. Your continued use of the Service after a change indicates your acceptance of the updated Terms.
Entire Agreement
These Terms, together with our Privacy Policy and any order form, schedule, or service description signed between us, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings, whether written or oral.
